Can a Landlord Deny an Emotional Support Animal?

The internet is filled with information on the requirements for service animals and ESA’s. There are websites all over that guide you here or there, promising registration for your animal if you just pay their fee. Sadly a lot of these sites are filled with misinformation and can lead you astray. In this article, we’ll discuss ESAs (Emotional Support Animals) in their entirety. Both tenants and landlords have rights in regards to what can and can not be done with a person's ESA and what law states are acceptable. 

What is an ESA? 

An ESA is an emotional support animal. They are intended to provide therapeutic assistance to a disabled individual. The type and breed of animal that fits in this category are broad and can range from small rodents to large dogs. The animal itself depends on the individual's needs and ability to care for each species and their unique needs.  

Who can have an ESA?

Emotional support animals are intended to be a support for disabled individuals who suffer from a variety of ailments including but not limited to severe depression, PTSD, and General Anxiety Disorder. 

Does an ESA need special training?

Yes and no. There is no requirement for certification for an ESA however the animal is required to facilitate the disabled person’s ability to function. If your ESA is canine, for example, it’s going to make a much better impression on others and be easier for the person with disabilities to maintain as a companion if they are a good canine citizen and are fairly well behaved when in public. 

Are there laws to protect my ESA?

Yes. There are laws to protect your ESA and there are laws to protect the Landlord where you may reside. The FHA (Fair Housing Act) is something you should familiarize yourself with. It gives all the points one must look at when bringing an ESA into their apartment or rental space. The FHA applies to almost all housing situations. 

What do I need to provide to my Landlord to have my ESA with me?

A request must be formally made to your landlord first to obtain an agreement to having an ESA in your apartment. The Landlord, in turn, may request reliable documentation about the person’s disability and need for an assistance animal. While the individual requesting permission does not have to disclose their disability they are required to prove, through medical documentation from a doctor or psychiatric specialist, that having an ESA in your apartment is fundamental to their health. 

Can my Landlord deny my ESA due to breed restrictions?

No. The only time a Landlord may deny a request for an ESA due to breed or size is when an animal is deemed dangerous on a case by case basis. While this is true, some homeowners and renters insurance will not allow certain breeds, allowing the Landlord to deny that breed. If an accommodation puts undue administrative or financial stress on the housing provider the animal may be denied. This can include drastic increases in homeowners’ insurance as well as property insurance. 

While this was only a brief overview, answering some of the most common questions, it sheds some light on the basics involving an ESA. Should you find yourself needing more information make sure you look at the Fair Housing Act and check both applicant and Landlord rights. The best way for you to have your ESA and to adhere to all rules is to be knowledgeable about the subject at hand. By knowing your rights and those of the person you may be opposing you can fight for your rights in a safe, legal manner.

Where To Cycle Around New York City

Going out for a bike ride, is risky but rewarding. Now that the weather is warming up, here are a few great paths to take. Especially as the weather warms up over the next few weeks.

Hudson River Greenway

This 11 mile stretch across the Hudson from Inwood to South Ferry is not only the most heavily used bikeway in the city, but it is part of the 300 mile East Coast Greenway, spanning from Maine to Florida. Aside from stunning views of the riverside, various landmarks like the George Washington Bridge and the Hudson Yards also surround riders. With a lane this long, it can be used for either a slow but casual ride, or a rather intense workout routine.

Coney Island Boardwalk

One doesn’t usually think of this thoroughfare as particularly cyclist friendly, especially when it gets crowded during the busy summer season. But even with the occasional cyclist during the day, biking is primarily allowed between 5 and 10 am. For those willing to commit to making the trip to the beach this early, they’ll get an intimate ride that’s augmented by the calming ocean breeze. At least until the oceanside restaurants and amusement rides open for the day.

Brooklyn Waterfront Greenway

But for those who don’t feel like waking up early to go cycling in Brooklyn, this 2.2 mile path is a perfect alternative. Running alongside New York Bay, this trail goes from Red Hook to Brooklyn Bridge Park, though cyclists will have to park their bikes upon arrival, since bikes are prohibited in the park and the surrounding promenades. Though if that ride still isn’t enough, there’s always the option of extending the ride to include crossing the legendary Brooklyn Bridge.

Bronx River Greenway

This path is currently a work in progress. Of the 23 miles planned, 10 miles are currently available in three separate segments: one mile near Oak Street on Mount Vernon, a 4.6 mile stretch that connects Bronxville and Scarsdale Avenue, and a 5 mile route from Hartsdale to Valhalla. Even though the complete opening is still quite a few years away, what is available right now is just as scenic as any existing bike path in the city.

Discover The Wines of New York

New York heralds a rich and lengthy wine history, and continues to maintain strong relevancy as a wine producing area, coming third in place behind California and Washington state. The country’s first bonded winery was founded here in New York, and the oldest operating winery in America is housed in New York as well.

Now, New York wine country boasts seven official wine regions, along with several additional subregions. There are more than 1600 family vineyards and over 400 wineries throughout New York, with the wine (and grape) industry generating “more than $4.8 billion in economic benefits annually for New York State.” 

For those unfamiliar with the history of wine production, that says a lot. Evidence accounts for winemaking in ancient cultures dating back as far as 6,000 B.C. and New York’s community of wine producers continue adding onto this centuries old tradition.

If you’re interested in discovering some of the wines New York has to offer, here are a few New York wineries you should know:

Brotherhood Winery

The Brotherhood Winery was established in 1839, and is America’s oldest winery. Located in Washingtonville, New York, Brotherhood is less than an hour and a half from New York City, and welcomes guests for tours, tastings and live music. If you have a special occasion on the horizon, such as a wedding, birthday party or corporate gathering, the Grand Salon can accommodate. The 19th century space offers a charming setting with a deeply historic backdrop, making it the ideal destination for any memorable event. 

One Woman Wines & Vineyards

The name behind Claudia Purita’s Long Island winery is literal. An Italian native, she grew up on her family's farm and has brought the values learned to her vineyards. “Her Story” illustrates a woman who’s attentive to the smallest details, patient and willing to go above and beyond for the sake of quality. Out of that perseverance came an array of wines, with selections for those who favor red, white or pink. While her wines are available for purchase online, One Woman Wines also has a tasting room with nine wines available for tasting and seven reserve wines for purchase. 

Red Hook Winery

The Red Hook Winery opened in 2008 and since then, their focus has truly been on bringing New York wines to consumers. They produce all of their wines “from grape to bottle” at their urban winery on Pier 41 and sell a host of options for wine lovers to sip on- like orange wines and unique red and white blends. This winery has received quite a bit of media coverage, and perhaps for good reason. Celine Bossart recounts her visit for Edible Brooklyn: “there’s something that Red Hook Winery brings to the table that’s very different from the others in its class: whereas the typical négociant tends to keep the spotlight in one place (on itself), a sharing-is-caring approach is more their style.” Red Hook Winery is now open for outdoor seating and wine tastings, which you can book in advance on their website. Ben Ish Winery 

Ben Ish Winery is only one of less than a handful of wineries located in Brooklyn. The company only offers dry red wines that are kosher, and carry Cabernet Sauvignon, Merlot, Syrah and Old Vine Zinfandel.
