How To Get Security Deposit Back From A Landlord

Most landlord/tenant relationships go smoothly. Renters pay their landlords a fee, and in return, they get a roof over their heads. If disagreements do occur, the vast majority involve the security deposit. Each state will have its own law regarding the security deposit, how the whole process is handled, and how it should be returned. Let's go over what it is, what it is supposed to be used for, and lastly, how to get it back quickly and hopefully easily.

What is a Security Deposit

Defined by Legal Zoom, a security deposit is money given to the landlord by the renter. It is used to cover any damage and repairs caused by the tenant. 

The security deposit is usually equal to one month's rent. But it could be more or less. State law will govern the amount. In Texas for example, there is no law limiting the security deposit. 

Many states will have rules indicating that the funds must be deposited in a separate escrow account. The landlord must provide the bank and account number where the so-called funds are placed. The funds cannot be used for any expenses the landlord incurs. 

In other more lenient states, the landlord won't have to account for the money. They can spend it on random expenses if they so choose. Although it sounds sketchy, that's the law. 

Damages: What Your Deposit Can Be Used For

So what can your landlord charge you for? In almost all cases, you can only be charged for items that you damage. This should not be confused with normal wear and tear. Let's talk about the definitions for both. Again renters shouldn't be charged for normal wear and tear. Here is a list of items that fall under this category

  • Worn doorknobs

  • Curtains faded by direct sunlight

  • Small scratches in wood flooring

  • Light stains in the carpeting

  • Chipped paint in the interior of the homes

  • Worn carpeting

  • Grimy interior of the refrigerator

These are examples of damages that you will be assessed for. Remember, you will have to pay for negligence as well. This can be defined as damage caused by your inability to take care of something. Here is a common list of items that may be damaged in apartment homes. 

  • Broken windows or mirrors

  • Punch holes in the walls 

  • Heavy stains in carpeting

  • Large scratches in wood flooring 

  • Chipped tile 

  • Dryer failure due to not cleaning and emptying dryer vents

A word about carpet cleaning. In TX, many apartments in Kingwood TX are assessing carpet cleaning fees. This should fall under normal wear and tear. Read your apartment lease carefully. If it's not in the lease, the community should not charge you for it. Most apartment management companies realize that most people won't even broach the subject. 

For tenants wondering how to get my security deposit back if I never signed a lease, it's crucial to document all rent payments and any verbal agreements, as these can serve as key evidence in lieu of a formal contract.

Security Deposit Don'ts

Now that you know what the security deposit is used for, let us cover some common questions that many renters have. 

You should pay your last month's rent. Private landlords usually require first and last month's rent. If you didn't pay last month's rent, don't think that you can just apply the security deposit to cover it. Not only will you incur late fees, but your landlord also won't be happy with you. The last thing you want on your  apartment credit report is a black mark. 

The only caveat is that your landlord provides a statement in writing that you can use the security deposit as your last month's rent. The reason you want it in writing is just in case you have to go to court to recover your money.

Moving Out: What you Need to Know

So your move out date is right around the corner. The first thing in order is to schedule a walk-through with your landlord or apartment manager. 

A walk-through allows a representative from the apartment, or it could be your landlord, to check out the entire interior of the residence. They will be able to relay to you what is damaged and what is normal wear and tear. If you disagree, this is a perfect time to see if you can come to an agreement. 

Now you will have a few options :

  1. Make the repairs yourself if you can

  2. Pay a vendor to do this for you

  3. Do nothing 

If the management company makes repairs, they will be deducted from the total of the security deposit. 

Additional Required Steps

Here are some additional steps you must take in order to receive your money. 

  • You must not be behind in paying your rent. If you are, you won't get your security deposit back

  • The damage must not exceed repairs. 

  • A forwarding address must be given to the management company. But don't worry, they aren't entitled to keep your money indefinitely. 

The Waiting Game

So you moved out. Each state will have different time limits that mandate how long your landlord has to send you back your money. Remember to give a forwarding address or you won't receive anything. 

When you do receive your money in the mail, here are some common scenarios

  1. You received the amount in its entirety

  2. The landlord did deduct monies for repairs (in many states they must account for this by including an itemized list of charges with receipts) 

  3. The entire amount was used to make repairs. In some cases, you might owe more money the damages exceeded the value of the security deposit 

What To Take Away 

Remember the security deposit is your money. If you want to get it all back, be sure and don't damage the apartment. Also, pay your rent on time. 

If you do both of the above, you shouldn't have too big of a deal getting your money back in your pocket.

How to Improve Your Small NYC Apartment

With New York City under lockdown, now is the perfect time actually to get around to improving your apartment for the better. It will help improve your quality of life and mental health, especially if your apartment is small. Small doesn’t mean bad. It just means you need to be creative, and to follow this guide to transform your small apartment into a little relaxing getaway:

1. Declutter 

Even in a small space, you would be amazed at how much clutter can end up in piles and in cupboards. Things that you don’t use, or need should go. For things that are big, bulky, and difficult to store, you should set them aside and have a look online to see if there is a tiny living alternative that can help you solve all your problems. 

With the Tiny Home movement and more than half of the global population living in cities, these small living solutions are becoming more popular. Before you give up on where to put those big mixing bowls, have a look online for nesting bowls or even pop-up mixing bowls that can fold flat. 

2. Give it a Fresh Coat of Paint 

If the paint looks tired, there are stains, or generally, the walls make you think ick it’s time to repaint it. Get permission from your landlord and order some paint and supplies. Don’t go for the cheapest color. It is cheap for a reason, and it does not look that great, nor does it last. You will want stain-resistant paint. For small spaces, light colors work best. 

3. Install Storage Right to the Ceiling 

Find bookshelves or other storage units that will fit from the floor to the ceiling. Alternatively, you can add baskets on top to increase the amount of storage up top. Though open shelves can be fun, for small apartments, it is better to choose an option that has cupboard doors so that you can hide the clutter away and feel like you have more space (at least visually). 

4. Use Reflective Surfaces to Add Light 

Add mirrors, or look for furniture that is reflective to bounce light throughout your apartment. Most small apartments are lucky to have one window, so you need to maximize that light throughout your home. 

5. Make Your Bed the Best Thing 

Your bed is going to take up a lot of space, so it should be the most welcoming thing in your room. Get rid of any old, bulky, or ugly bed frames, and above all else, make sure your mattress is the most luxurious thing you have ever laid on. It’s for this reason why you should invest in an eco-friendly mattress. An environmentally conscious mattress will enable you to enjoy a better quality of sleep, as well as ensuring you are not exposed to the toxic chemicals which are used to create other traditional mattresses. Instead, you can rest easy knowing your mattress is created using organic cotton, wool, and latex.    

6. Find Multi-Purpose Furniture 

With all those main tasks done, it’s finally time to keep an eye out for multi-purpose furniture. Don’t fall into the pit of buying some solution that you don’t need but do keep an eye out. For example, you could get a portable kitchen island that acts as a desk and storage unit when you aren’t cooking. These items that can be used for more than one thing are a gold mine for small spaces, as they increase the function of your home.

The fitness center also makes sure to include green spaces by giving you a view of the terrace through more floor-to-ceiling glass walls.

Greenwich West 

Incorporating green spaces with fine art, the 290 feet tall Greenwich West commissioned the artist Aaron Zulpo to create five oil paintings that represent and depict life throughout the residential tower. The building draws its inspiration from 20th century French designs conceived by Parisian design teams. Located at 110 Charlton Street, the residences come with views of the Hudson River, New York Harbor, and the Statue of Liberty. 111 Montgomery- Prospect Park 

111 Montgomery, developed by LIVWRK and CIM, is the first full service, newly built condominium in Crown Heights. Located near both the Brooklyn Botanical Gardens and Prospect Park, the building offers studio and three-bedroom homes. The interiors are designed by Brooklyn-based architecture and interior design firm Mesarch Studio. The open layouts accompanied with the oak wide-plank flooring, includes various amenities from a resident lounge to a rooftop terrace and community garden. Prices range at the 111 Montgomery from $500,000 to $1,800,000.

During this current stressful time, staying home is not only integral for our own health but for the safety and health of others. Despite this, the desire to simply move makes the necessity of social isolation a daunting task and, at days at a time, overwhelming.  

As a modern culture we have had breakthroughs in our virtual experiences. Whether the focus be on augmented reality games or completely immersive virtual reality- we can experience things in a way that we wouldn’t have been able to in the past. Granted- the virtual can never truly compare to reality- however, its ability to mirror the same breathtaking views can do more than just ease our tensions. It can give you something to look forward to, future plans to make.  

Whether you’re an avid traveler, love new experiences, or are simply trying to find things to do, below are a few virtual reality experiences to keep you occupied or to spark something within:  

Travel Throughout Japan

The Japan National Tourism Organization created a 360-degree virtual reality movie incorporating experiences and scenes throughout the country, navigating visitors through their rich landscapes. You can feed of bamboo forests, Geisha performances, and Tokyo’s famous Shibuya Crossing (to name a few without spoiling the beauty of the surprises). To celebrate the beginning of Spring you can also view the traditional Japanese hanami, the ancient and celebrated tradition of admiring newly bloomed flower blossoms. You do need to make sure to have a smartphone in order to view, and you have a choice of the 360-degree VR movie or you can opt for the interactive vision.
